Terms of Service

1. Acceptance of Terms

By accessing or using Hailr at hailr.ai ("the Service"), operated by Platform as a Service SRL, a company registered in Romania ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including accounts on Pay as you go and paid subscribers.

2. Description of Service

Hailr is a B2B SaaS platform that automates website discovery and outreach. The Service includes:

  • AI-powered website harvesting and discovery
  • Automated website scouting and qualification
  • Contact information extraction (emails and forms)
  • Automated outreach via email (SMTP) and contact form submission
  • CAPTCHA solving, included on Pay as you go, Starter and Growth and with your own 2Captcha key on BYOK
  • Campaign management dashboard and analytics

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Terms

  • You must be at least 18 years old to use the Service.
  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account and password.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized access to your account.
  • One person or organization may not open more than one account to receive free messages.

4. Acceptable Use

You agree to use Hailr responsibly and in compliance with all applicable laws. Specifically:

You Must:

  • Comply with all applicable anti-spam laws, including CAN-SPAM (US), GDPR (EU), CASL (Canada), and any local regulations in the jurisdictions where you operate or where recipients are located.
  • Ensure your outreach messages are truthful and not misleading.
  • Honor opt-out and unsubscribe requests promptly.
  • Have a legitimate business purpose for contacting each recipient.
  • Include accurate sender identification in all outreach.

You Must Not:

  • Send unsolicited bulk messages (spam) or messages with deceptive content.
  • Use the Service to harass, threaten, or abuse any person or organization.
  • Use the Service for any illegal activity, including fraud or phishing.
  • Attempt to circumvent rate limits, plan limits, or security measures.
  • Scrape, reverse-engineer, or attempt to extract source code from the Service.
  • Share your account credentials with third parties.
  • Impersonate another person or organization in outreach messages.
  • Use the Service to collect personal data for purposes unrelated to B2B outreach.

Important: Hailr provides outreach automation tools. You, the user, are solely responsible for the content of your outreach messages and for ensuring compliance with all applicable laws. We are a tool provider, not the sender of your messages.

5. Billing and Payments

Plans, Delivered Messages and Your Own API Keys

Hailr has three plans paid per delivered message and one BYOK plan. On Pay as you go, Starter and Growth the Service runs on our own AI, search, CAPTCHA and proxy accounts, and you pay for delivered messages: a message with a fixed or light text counts as one message, a personalized message counts as two. A message is delivered when a contact form submission was confirmed or very likely sent, or when an email was accepted by your email provider's server. Contacts that failed, were skipped or were interrupted, forms whose result is unclear, and websites you mark as sent yourself cost nothing.

  • Starter and Growth are monthly subscriptions that include delivered messages every month. Monthly messages are replaced at each renewal and do not carry over.
  • Each plan also sets how fast the Service works for you: parallel browser sessions, contact forms per hour and active campaigns. The hourly limit counts contact forms only: emails go out through your own email account, at the pace you set.
  • On Pay as you go, Starter and Growth you can buy messages at any time, for any whole number of dollars from $10 to $5,000, at the message price of your plan. Purchased messages do not expire.
  • When you verify your email address on Pay as you go, Starter or Growth, you get 25 free messages, once per account.
  • Until your first payment (a top-up or a monthly plan), your account can run one search of up to 100 Google searches and, on Pay as you go, one campaign at a time.
  • Campaigns pause when you have no messages left, and need at least 10 messages left to start or resume. Messages already on their way when your balance runs out are still counted when they are delivered, so your balance can go below zero. The difference is taken from the next messages you receive or buy.
  • BYOK is a monthly subscription with no message balance and no limit on messages. On BYOK the Service runs on API keys you provide (OpenAI, Serper, a proxy provider and optionally 2Captcha).
  • Subscriptions renew every month until cancelled. You may cancel at any time. Cancellation takes effect at the end of the current billing period, unless you close your account (Section 11). When a subscription ends your account moves to Pay as you go and keeps its purchased messages.
  • If a payment fails, your plan stays active while the payment is retried. If it cannot be collected, your account moves to Pay as you go.

On BYOK you are billed by the providers whose keys you connect, directly and under their own terms, and you are responsible for those keys. Charges from those providers (OpenAI, Serper, a proxy provider, 2Captcha and your email provider) fall outside our refund policy and the limit of liability in Section 9.

Refunds

We offer refunds on a case-by-case basis within 14 days of purchase. Send refund requests to hello@hailr.ai.

Messages that were already delivered are not refunded.

Price Changes

We may change pricing with 30 days advance notice. Price changes take effect at the start of your next billing period.

6. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by Platform as a Service SRL and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service.

You retain ownership of all content you create through the Service, including campaign configurations, outreach messages, and exported data.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

You acknowledge that campaign data (discovered websites, contact information, outreach results) is generated by automated processes and may not always be accurate. You are responsible for verifying data before relying on it.

When you connect a reply inbox, you authorize us to read all mail in its inbox folder and to send each message that is not skipped to OpenAI (with our account on Growth and with your own key on BYOK), to find the replies to your outreach. This mail is read automatically by our systems and by AI models, not by people, so that the leads can be sorted correctly. Connect only a mailbox you are allowed to give us access to.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience outages. We will provide reasonable notice for planned downtime.

Outages at third-party services (search APIs, AI providers, CAPTCHA services, proxy providers and your email provider) may affect the functionality of certain features. These are outside our control.

9. Limitation of Liability

To the maximum extent permitted by law, Hailr and its operators shall not be liable for:

  • Any indirect, incidental, special, or consequential damages.
  • Loss of profits, data, or business opportunities.
  • Damages arising from your use of the Service for outreach, including any legal claims made by recipients of your messages.
  • Inaccuracies in discovered data, contact information, or AI-generated content.
  • Service interruptions or data loss.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Platform as a Service SRL, the operator of Hailr, and affiliates from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Service.
  • Your outreach messages and campaigns.
  • Your violation of these Terms or any applicable law.
  • Any claim by a third party related to messages you sent through the Service.

11. Termination

You may close your account at any time in Settings. Closing it cancels your subscription immediately, not at the end of the current billing period, and deletes its message balance, including messages you bought and did not use.

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or use the Service for illegal purposes. In cases of serious violation, termination may be immediate without notice.

Upon termination, your access to the Service will cease and your data will be deleted in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a prominent notice on the platform at least 30 days before changes take effect.

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and Romania. Any disputes shall be resolved in the courts of Romania, unless otherwise required by applicable consumer protection laws.
